Andrew Katzen in Law Society Gazette on SRA’s fining power plans

Head of Regulatory Law Andrew Katzen has written an article for the Law Society Gazette on the Solicitors Regulation Authority’s proposals to change its fining powers for misconduct.

The SRA’s plans are set out in a consultation document which, Andrew writes, “merits close attention”.

Proposals include a plan to extend the SRA’s internal powers to allow for unlimited fines for all forms of misconduct (not just financial). The regulator also wants no upper limit on the fines it can impose on law firms and individual solicitors found to have committed the worst forms of misconduct.

Andrew raises concerns about this. He also examines the proposals’ potential impact on the Solicitors Disciplinary Tribunal; and addresses the regulator’s proposals regarding drink driving.
