Ben Rose and Tom Bushnell in Times on lessons of Supreme Court LIBOR / EURIBOR verdict

Hickman & Rose’s co-founding partner Ben Rose and senior associate Tom Bushnell have written an article for The Times newspaper on the lessons of their recent victory at the Supreme Court for client Carlo Palombo.

Ben, Tom and Nisha Patel last week won the quashing of Mr Palombo’s conviction for fraud related to alleged EURIBOR manipulation. The case was heard alongside that of Tom Hayes, whose conviction for fraud related to alleged LIBOR manipulation was also quashed.

In their article Ben and Tom highlight the original trial judges’ failure to give juries the freedom to determine for themselves whether the banks’ rate assessments were false.

These judicial failures were upheld by the Court of Appeal five fimes and were, the Supreme Court ruled, an “obvious mistake”, Ben and Tom write.

They argue that the Supreme Court’s correction of this error “underlines the importance of juries being left to decide all factual questions” and demonstrates the need for fundamental reform of the criminal appeals process.
