Ben Rose is Law Society Gazette’s ‘Lawyer in the News’ for Auriol Grey Appeal Court win

Hickman & Rose’s co-founder Ben Rose has been profiled by the Law Society Gazette as its ‘Lawyer in the News‘ for his work quashing Auriol Grey’s manslaughter conviction at the Court of Appeal.
As well as talking about his professional journey, Ben discusses the Grey case, which he describes as “one of the most shocking miscarriages of justice I have known”.
Ben describes how, in order to properly prove the offence of unlawful act manslaughter the prosecution should have showed Auriol committed an underlying criminal offence: in this case common assault.
“The police, the CPS, prosecuting counsel, Auriol’s defence lawyers, the trial judge, and the single judge at the Court of Appeal all failed to realise this“, Ben writes.
“Fortunately, the full Court of Appeal did, and it gave short shrift to the prosecution’s argument that Auriol’s panicked gesticulating amounted to common assault.”
