High Court dismisses personal injury claim against Maksim Bakiyev relating to attempted murder of Sean Daley

Today a personal injury claim brought against the son of the former President of the Kyrgyz Republic, Mr Maksim Bakiyev, by British businessman Mr Sean Daley was dismissed at the High Court of Justice in London.
Mr Daley had alleged that his shooting and attempted murder in Bishkek, the capital of the Kyrgyz Republic, in July 2006 had been “organised and arranged” by Mr Bakiyev to prevent him (Mr Daley) from jeopardising a fraudulent scheme to obtain a mining licence for a Kyrgyz goldmine.
Mr Justice Supperstone’s judgment, which variously described the evidence submitted by Mr Daley and his witnesses as “not credible“, “unsatisfactory” and “wholly implausible“, can be found here. He went on to say that the circumstances in which the statement of the main witness of the alleged arrangement to murder Mr Daley was taken gave “rise to real concerns that it was made in collaboration with Mr Ismailov [the Kyrgyz prosecutor] for the purpose of ensuring the conviction of [Mr Bakiyev]…”
