Stefano Ruis in The Guardian on Andy Malkinson’s battle for compensation

Civil litigation partner Stefano Ruis has been quoted in The Guardian newspaper in relation to Andy Malkinson’s battle for compensation after spending 17 years in prison for crime he did not commit.

Andy Malkinson’s conviction for rape was overturned in July 2023. He formally applied for compensation under the miscarriage of justice compensation scheme in September this year and was recently informed he would likely need to wait an average of 31 weeks from this application for a decision on his eligibility, taking him up to April 2025.

Andy told The Guardian’s Emily Dugan that he was, in the meantime, struggling to survive and that the onerous application process is like “having to prove I’m not lying all over again”.

Stefano told the paper: “Quite understandably, Mr Malkinson does not consider [a 31-week wait] reasonable. It would seem straightforward in this case for the secretary of state to make an immediate decision, whereupon an interim compensation payment can be considered.”
