Toby Wilton in media on IOPC investigation of police officers in Andy Malkinson case

Toby Wilton has been quoted across the print and broadcast media following the IOPC’s announcement that it is investigating four former police officers for potential gross misconduct in the Andrew Malkinson case, with one of those officers also under criminal investigation.

Mr Malkinson spent 17 years in prison for a crime he did not commit before his conviction was quashed by the Court of Appeal last year.

Last week, the IOPC announced that, as part of an ongoing investigation into complaints submitted by Mr Malkinson regarding Greater Manchester Police’s conduct, four former GMP officers are under investigation for potential gross misconduct, one of whom also faces investigation for the potential criminal offences of misconduct in public office and perverting the course of justice.

It the announcement, IOPC Regional Director Catherine Bates described Andy’s case as “one of the worst miscarriages of justice in British history.”

Toby Wilton, who represents Mr Malkinson in respect of his police complaint and claims for compensation, told the BBC’s Today programme that the IOPC investigation an unusual step “which they really – I can tell you – do not reach in a great many cases.”

Asked what the development means, Toby said: “It is important to reflect on what it is that the IOPC is investigating and how that relates to the conduct in question [….]. A lot of the stuff that they are investigating goes right to the heart of what the Court of Appeal based the quashing of Andy’s conviction on.”

Quoted in the Guardian, Times and elsewhere, Toby said: “Twenty years on from Mr Malkinson’s wrongful conviction no police officers have yet faced any sanction for their role in the miscarriage of justice that he suffered, Greater Manchester Police are yet to admit their responsibility for what happened, and he is yet to receive any compensation.

“This announcement that four officers involved will now face a misconduct investigation, and one will now face criminal investigation, is an important first step — but it is vital that all those responsible at Greater Manchester Police, as well as the wider force, are held to account”
