Toby Wilton pushes for miscarriage compensation cap removal following Government concession

Civil litigation associate Toby Wilton is pushing the Government to remove its cap on miscarriage of justice compensation following its agreement to increase it by 30%.

Toby, together with APPEAL, exonerated former prisoner Andy Malkinson and other campaigners, has been pushing for radical reform to the Miscarriage of Justice Compensation Scheme, which since 2008 has capped maximum compensation at £1m regardless of the circumstances of the individual case.

Following sustained pressure, the Government has now agreed to increase the cap to £1.3m.

But while campaigners have broadly welcomed this concession, Toby points out that it does not come close to the nearly £2m the 2008 cap would be worth now as a result of inflation.
