Business Crime partner Ross Dixon has been quoted in a Law Society Gazette article on the challenges facing the Serious Fraud Office under its new director Nick Ephgrave.
Ross is quoted in relation to disclosure, described by former SFO director Lisa Osofsky as one of the agency’s biggest challenges, and the review being conducted by Jonathan Fisher KC.
Ross argues that “one change that would make a big difference [….] would be the introduction of a presumption in favour of disclosure in a small number of categories of material“.
He goes on: “Take business emails. In these serious cases, huge time and resource are currently being spent by both sides arguing about which of a defendant’s emails should be disclosed.
“A presumption in favour of disclosure is a much fairer approach and would cut out much of the time currently wasted on these skirmishes.“
